El Parricidio como fundamento de la ley: Una lectura de “Tótem y Tabú” desde la perspectiva de León Rozitchner

Abstract:

The present paper begins with a first section which resumes the “scientific myth” that Freud expounds in Totem and Taboo, where the parricide is indicated as a foundational act for paternal law. After this presentation it is developed a reading of the quoted book made by the Argentinian philosopher León Rozitchner. According to this author, Freud accounts for the historical determination of subjectivity, by trying to demonstrate the way that history is found in it, articulating and organizing repressively the “psychic apparatus”. But, at the same time, in that work the possibility of a radical change in the conditions of the oppressed life is noted. The “fraternal alliance” establishes, on the space left by the murdered patriarch, the radically contingent foundation of self-determination and equality. In the third section of this paper, it is presented, in contrast, Pierre Legendre’s Lacanian idea of the Father as “Reference”, as a necessary condition for symbolic order in which the subject is inscribed. In the conclusions it is explained a “post-foundationalist” view of the law that has its basis in the interpretation of Totem and Taboo made by Rozitchner.
