%X En el sentido jur赤dico, la voz "liberalidad" denota una categor赤a de actos a los que pertenece la donaci車n. Pero tambi谷n contiene una especial赤sima acepci車n, en cuanto se aplica a toda atribuci車n patrimonial que no sea debida, de modo de ser "libre" en cuanto no dependa m芍s que del arbitrio del que la confiere. El estudio intenta, por un lado clarificar la peculiaridad de la donaci車n como liberalidad y, por otro, purificar el concepto de donaci車n de cualquier elemento subjetivo ligado a la voluntad del donante. In the judicial sense, the term "liberality" denotes a category of acts to which donation belongs to, but it also has a very specific meaning, as it applies to all equity attribution that is not due, in this way being "free", as long as it depends only on the discretion of the party granting it. This article tries, on one hand, to clarify the peculiarity of donation as liberality and, on the other, to purify the concept of donation of any subjective element related to the will of the donor.
