%T Should Economics Play a Role in Copyright Law and Policy?

%X [Abstract] Given the utilitarian rationale for copyright and the economic incentives this law aims to create for investment in intellectual labor, it is somewhat surprising that economic analysis has thus far played such a small role in copyright law and policymaking. This article suggests several reasons why economic analysis has had such a limited role in the past and why there may be resistance within the copyright policymaking community to giving economic analysis a more substantial role in the future. It goes on to give some examples of legislative uses of economic analysis to inform sound policy-making and of uses and misuses of economic analysis as a tool in interpreting the scope of copyright. The article predicts that economic analysis will have more influence in legislative, policy, and judicial interpretation of copyright in the future.*****[R¨¦sum¨¦]¨¦tant donn¨¦ les fondements utilitaires du droit d¡¯auteur et les incitations ¨¦conomiques que cette loi cherche ¨¤ cr¨¦er pour favoriser l¡¯investissement dans le travail intellectuel, il est assez ¨¦tonnant que l¡¯analyse ¨¦conomique ait jou¨¦ jusqu¡¯ici un si petit r le en mati¨¨re des lois et des politiques sur le droit d¡¯auteur. L¡¯article sugg¨¨re plusieurs raisons expliquant ce r le limit¨¦ dans le pass¨¦ et la r¨¦ticence possible des d¨¦cideurs politiques en la mati¨¨re ¨¤ lui donner plus d¡¯importance dans l¡¯avenir. Des exemples sont donn¨¦s de l¡¯utilisation l¨¦gislative de l¡¯analyse ¨¦conomique aux fins de l¡¯¨¦laboration de politiques valables, en soulignant les bonnes et les mauvaises utilisations de cette analyse afin d¡¯interpr¨¦ter la port¨¦e du droit d¡¯auteur. L¡¯article pr¨¦dit que l¡¯analyse ¨¦conomique aura une plus grande influence dans les ann¨¦es ¨¤ venir dans l¡¯¨¦laboration des politiques l¨¦gislatives et l¡¯interpr¨¦tation judiciaire du droit d¡¯auteur.
