%X Este artigo tem como objeto a reflex o sobre o fundamento dos direitos humanos e sua indissoci¨¢vel rela  o com os direitos fundamentais, no ambito do estado de direito contemporaneo. Para tanto, procuraremos estabelecer poss¨ªveis converg¨ºncias te¨®ricas entre Joaqu¨ªn Herrera Flores e Luigi Ferrajoli. A an¨¢lise dos direitos fundamentais, a partir da teoria garantista, e dos direitos humanos, com base da teoria cr¨ªtica da reinven  o, ¨¦ tanto um desafio te¨®rico quanto pr¨¢tico do s¨¦culo 21. Isto, em virtude da necessidade da investiga  o de seus fundamentos te¨®ricos e possibilidades de efetiva  o na dial¨¦tica da pr¨¢xis da vida em sociedade, para que as conquistas hist¨®ricas de direitos n o sejam reduzidas ¨¤ mera ret¨®rica hegem nico-conservadora de uma ordem global fundada na desigualdade e explora  o. Percebe-se, ent o, que o constitucionalismo e os direitos n o importam em conquistas, mas em programas normativos a serem buscados diariamente, tal como a democracia e a paz. Nesse sentido, situa-se a importancia do estudo dos direitos, estejam eles em normativas nacionais ou internacionais, bem como situ¨¢-lo sem sua transitoriedade e constante constru  o, em suma, em sua historicidade, para serem efetivamente garantidos. The object of this essay is the reflection about the foundation of the human rights and their inseparable relation with the fundamental rights, in the contemporary state of right sphere. For both, it seeks to establish possible theoretical convergences between Joaqu¨ªn Herrera Flores and Luigi Ferrajoli. The fundamental rights analysis, from the warranty theory; and the human rights analysis, based on the critical theory of reinvention, are both a theoretical, as much as a practical 21st century challenge. This is due to the need of researching their theoretical foundation and possibilities of implementation in the praxis' dialectic in life in society, so that the historical achievements of rights aren't reduced to mere hegemonic-conservative rhetoric of a global order founded on inequality and exploitation. Therefore, it is perceived that the constitutionalism and the rights don't encompass achievements, but normative programs to be seek on a daily basis, such as democracy and peace. Thus, it is situated the importance of studying the rights, whether they're in national or international norms, as well as situate them in their transience and constant construction, in short, in their historicity, so that they're actually guaranteed.
