%X Resumo O artigo aborda a luta pela extin  o do direito pautada pela afirma  o do comunismo. Com Pachukanis, analisa a posi  o antidireito como indissoci¨¢vel da supera  o das condi  es hist¨®rico-pol¨ªticas do capital. Para o jurista russo, a luta pela aboli  o da forma jur¨ªdica n o est¨¢ subordinada a outras esferas de atua  o (econ mica, pol¨ªtica ou cultural), assumindo uma autonomia pr¨®pria no interior das formas de poder do capitalismo. A transi  o ao comunismo depende da extin  o do conjunto de formas com que opera o capital. Com Negri, mais do que destrui  o da forma do capital, tem-se o antidireito como instancia de contrapoder, como uma positividade que j¨¢ ¨¦ o comunismo. A luta contra a forma jur¨ªdica se d¨¢ ¡°dentro e contra¡± o pr¨®prio direito, com a ativa  o e potencia  o dos direitos vivos que habitam o interior do direito estatal. O comunismo confunde-se com a transi  o, como a constru  o aqui e agora de institui  es do comum. O direito do comum se apresenta, assim, como a express o afirmativa da extin  o do direito aprisionado entre o p¨²blico e o privado, o estado e o mercado capitalistas. Palavras-chave: Marxismo; Comunismo; Antidireito; Direito do comum. Abstract The articles goes from the struggles for extinction of law to the communist affirmation of the otherness of law. Within Pachukanis, the analysis of anti-law stands altogether with historical-political conditions of capital, that must be overcome. For the russian juridicist, the struggle toward form of law extinction isn¡ät subordinated to other practical  fields (like economical, political or cultural ones), beholding an automony internal to forms of capitalistic power. The communist transition depends on the capitalistic set of power forms. Within Negri, beyond the sole destruction of capital, there is an anti-law as instance of counter-power, as a positivity that already is communism. The struggle against juridical form happens ¡°inside and against¡± the law, through activation and potentiation of living rights within civil law. Communism merges with the transition itself, as the here and now construction of institutions for the common. The law of the common presents, therefore, as the affirmative expression for the extinction of a law closed between public and private, capitalistic state and market.
