%X Resumo: O artigo pretende oferecer uma reinterpreta  o do debate tradicional sobre abstra  o da forma jur¨ªdica como domina  o ¨¤ luz da teoria dos sistemas de Niklas Luhmann. Para tanto, utiliza como pressuposto a releitura marxista do processo de diferencia  o do direito oferecida por Raffaele de Giorgi no in¨ªcio dos anos 1980. Sustenta-se que o car¨¢ter complexo e contingente do sistema jur¨ªdico e do sistema social modernos exige, paradoxalmente, padr es e projetos de certeza que servem para ocultar ou conter a incerteza que os constitui. Dessa perspectiva, a no  o luhmanniana de generaliza  o de expectativas normativas ¨¦ compreendida como a produ  o pelo direito de modelos abstratos de orienta  o que resistem a mudan as concretas, mas, ao mesmo tempo, submetem-se a sele  es contingentes, necess¨¢rias para controlar eficazmente o elevado n¨²mero de surpresas que uma sociedade sem fundamentos metaf¨ªsicos pode produzir. Ao final, conclui-se que, a partir desta alternancia contradit¨®ria e paradoxal entre certeza e incerteza, o direito torna-se um sistema moderno de controle da sociedade. Abstract: The article intends to reinterpret the traditional debate on the abstraction of legal forms as domination in light of Niklas Luhmann¡¯s systems theory. Therefore, it finds its presuppositions in the Marxist reading of differentiation of law as proposed by Raffaele de Giorgi in the beginning of the 1980¡¯s. The article shows that the complexity and the contingency of modern social and legal systems paradoxically demands patterns and projects of certainty to hide or restraint the uncertainty they constitute themselves. In this sense the luhmannian notion of generalizing normative expectations is comprehended as the legal production of abstract models for guidance that resist concrete changes but at the same time are susceptible to contingent selections, which are necessary to effectively control the high number of surprises that a society lacking in metaphysical foundations may produce. I then conclude that because of this contradictory and paradoxical alternation between certainty and uncertainty law is a modern system of social control.
