%X Modern law has shifted towards a positivistic mode of reasoning,and is the instrument of a form of politics that claims wide©\ranging rights of control. In combination with an increase of environmental complexity, law is impacted strongly. It is quantitatively extended, thereby losing its normative power. A globalization of world conditions enters the situation as a new factor. As law has the ability to globalize itself, whereas politics can only do so in a limited way (not a world state), possibilities for a partial re©\disengagement of law from politics result from this. Law is now able to face politics more strongly from a basis of legitimization that is independent from politics.Das Recht der Moderne ist auf den Begrščndungsmodus der Positivit t umgestellt, und es ist Instrument einer Politik mit weitreichendem Steuerungsanspruch. In Kombination mit einer Steigerung der Umweltkomplexit t ergibt sich daraus fščr das Recht eine starke Belastung. Es wird quantitativ ausgedehnt, an normativer Kraft aber eher  rmer. Als neuer Faktor tritt die Globalisierung der Weltverh ltnisse in diese Situation ein. Da das Recht sich globalisieren kann, die Politik aber nur begrenzt (kein Weltstaat), ergeben sich daraus M glichkeiten der partiellen Wiederabkoppelung des Rechts von der Politik. Das Recht k nnte der Politik von politikunabh ngigen Legitimationsgrundlagen her verst rkt wieder eigenst ndig gegenščbertreten .
