To ignore their personal characteristics and equate them to other individuals in the community is not appropriate to the principles of equality. The concepts of equal educational opportunities are offered to individuals as of legal right. The right must be designed to meet their educational, social and emotional needs. In democracy, the right to equality means not giving equal rights for all, it means maintaining balance by giving rights according to their needs.The purpose of the study is investigation of the rights and contents that are provided to the gifted individuals in a different perspective since Ottoman Empire to the present. The study, literature review method have been used in which many sources have been examined detailed from the pre- republic era to the present. As a result, deficiencies in the gifted and talented rights recognized were identified and educational dimensions of rights of gifted and talented children were discussed. Attention was drawn to the necessity of more specific rights which defend educational content like programs designed for gifted and talented children, teachers, and materials for gifted individuals.
