%0 Journal Article %T L¡¯identification en justice ¨¤ l¡¯¨¦poque abbasside In-court identification under the Abbasids %A Mathieu Tillier %J Revue des Mondes Musulmans et de la M¨¦diterran¨¦e %D 2012 %I Universit¨¦ de Provence %R 10.4000/remmm.6638 %X Cet article se penche sur l¡¯identification des principaux acteurs du syst¨¨me judiciaire ¨¤ l¡¯¨¦poque abbasside (iie-ive/viiie-xe s.), tant dans la proc¨¦dure ordinaire que dans la proc¨¦dure ¨¦pistolaire, ¨¤ travers des sources biographiques et juridiques relatives ¨¤ la province iraqienne. Si l¡¯identification du juge, des plaideurs, de l¡¯objet du litige et des t¨¦moins ¨¦tait n¨¦cessaire afin qu¡¯un proc¨¨s parvienne ¨¤ son terme, les enjeux juridiques n¡¯¨¦taient pas les m¨ºmes pour chacune de ces cat¨¦gories. Les traits physiques, les artefacts et le nom furent autant de crit¨¨res retenus par les juristes pour proc¨¦der au travail d¡¯identification. Il appara t au final que l¡¯identification nominale des individus passait avant tout par leur notori¨¦t¨¦, concept qui fut th¨¦oris¨¦ par les juristes anafites d¨¨s le iiie/ixe si¨¨cle. This article investigates through biographical and legal Iraqi sources how the main protagonists of the judiciary under the Abbasids in the 2nd-4th/8th-10th centuries were identified, both in proceedings and in communication between judges. The judge, the parties, the matters at issue and the witnesses had all to be identified in order to try a lawsuit; however, the legal issues involved in their identification varied according to each of these categories.
