%X While maintaining its inherent characteristics, inspired by a violent logic of domination, the Mafia is evolving, becoming capable of dealing with society in different contexts and in ways that are beyond its archaic methods of operation.In this sense, the Italian penal jurisprudence has authorized the institution of the crime of possible complicity in mafia organized crime with the attempt to combat such a form of flanking on mafia association and contribution, perpetrated by outsiders to the traditional social environment of this phenomenon.A carefully reading of this offense allows the author to trace the evolution of the Supreme Court jurisprudence on possible complicity in mafia organized crime, grasping the critical issues and suggesting a possible legislative solution.M¨ºme si ses caract¨¦ristiques typiques, inspir¨¦es par une logique violente de domination, restent inchang¨¦es, la mafia ¨¦volue, devenant capable d¡¯¨¦tablir des relations avec la soci¨¦t¨¦ globale grace ¨¤ des modes op¨¦ratoires diff¨¦rents par rapport ¨¤ ses propres m¨¦thodes archa ques. En ce sens, la jurisprudence a autoris¨¦ l¡¯utilisation du concours externe en association mafieuse pour essayer de combattre les formes de soutien et de contribution ¨¤ l¡¯association mafieuse assur¨¦es par des personnes ¨¦trang¨¨res au contexte social traditionnel du ph¨¦nom¨¨ne. Une lecture prudente de ce d¨¦lit permet d¡¯examiner l¡¯¨¦volution jurisprudentielle de la Cour de Cassation afin de saisir les criticit¨¦s et d¡¯envisager une possibilit¨¦ de solution normative.
