%X ¨¤ travers l¡¯¨¦tude du dossier de Mikh¨©mar, un jeune fall¨¡h (paysan ¨¦gyptien) condamn¨¦ ¨¤ mort pour meurtre en 1893, cet article montre qu¡¯une approche des archives centr¨¦e sur les traces mat¨¦rielles laiss¨¦es par le processus de composition et de recomposition du dossier permet de restituer en partie la performance des diff¨¦rents acteurs du processus judiciaire, et contribue par l¨¤ m¨ºme ¨¤ jeter une lumi¨¨re nouvelle sur le syst¨¨me de justice colonial au tournant du xxe si¨¨cle. Plus pr¨¦cis¨¦ment, l¡¯analyse des traces ¡ª citations entre parenth¨¨ses et p¨¦titions en annexes ¡ª laiss¨¦es par la n¨¦gociation, qui se d¨¦roule tout au long de la proc¨¦dure entre la famille de la victime et les autorit¨¦s judiciaires autour de la nature commandit¨¦e du meurtre et des poursuites ¨¤ engager contre les responsables, r¨¦v¨¨le ¨¤ la fois la dimension conflictuelle et ¨¦minemment politique du processus de d¨¦cision des magistrats et une capacit¨¦ d¡¯expression et de contestation du syst¨¨me tout ¨¤ fait insoup onn¨¦e de la part des fall¨¡h¨©n. Through the study of the legal file of Mikh¨©mar (a young fall¨¡h or Egyptian peasant sentenced to death for murder in 1893), this article shows that an approach to the archives focusing on the material traces left by the process of composing and recomposing the file makes it possible to partially reconstruct the performance of the different actors of the legal process, and thereby helps to shed a new light on the colonial justice system at the turn of the 20th century. More precisely, the analysis of the traces ¡ªquotations between brackets and petitions in appendices¡ª left by the negotiation that unfolded throughout the procedure between the victim¡¯s family and the legal authorities over the nature of the crime as a proxy murder and the action to be taken against those responsible, reveals both the conflictual and highly political dimension of the legal professionals¡¯ decision-making process and an unsuspected ability on the part of the fall¨¡h¨©n to express themselves and challenge the system.
