%X This paper presents the theoretical postulates of Restorative Justice in its original matrix, from an objective alternative sociability and this process included an autochthonouslegality and emancipatory. Making as a complex process of social democratic and dialogical construction, facing the present and future and also to rescue the social ties and solidarity, guided by the principles of co-production and contact 每 inter-relationshipand inter-dependence. Thus, when analyzing the legal, factual and epistemological fits the need of eruption dynamics of socialityand alternative dispute resolution. Based on the theoretical assumption that still is disregard of the state, it ceases to be the central organ of the social structure and regulatory framework, to become, at best, contributing to a dynamic and culturally constructed social emancipation and sociability.Resumo: O presente trabalho traz os postulados te車ricos da Justi a Restaurativa em sua matriz origin芍ria, a partir de um objetivo de alternativa de sociabilidade e incluso neste processo uma juridicidade aut車ctone e emancipat車ria. Fazendo-se como um processo complexo de constru  o social democr芍tica e dialogal, voltada ao presente e ao futuro, assim como tamb谷m de resgatar os la os sociais e de solidariedade, pautado pelo princ赤pios de coprodu  o e do contato 每 inter-relacionamento e interdepend那ncia. Assim, se analisa em que contexto jur赤dico, fatico e epistemol車gico se insere a necessidade de irrup  o de dinamicas alternativas de sociabilidade e de resolu  o de conflitos. Partindo-se ainda do pressuposto te車rico que 谷 prescindir do Estado, que deixa de ser o 車rg o central da estrutura social e regulat車ria, para se tornar, na melhor das hip車teses, contribuinte de uma dinamica s車cio e culturalmente constru赤da de emancipa  o e sociabilidade.
