Neste cen¨¢rio, discute-se se o monop¨®lio criado na ¨¦gide da Constitui o passada para o servi o postal e o correio a¨¦reo nacional, desempenhado pela Empresa Brasileira de Correios e Tel¨¦grafos, fora, de fato, recepcionado pela legisla o constitucional ora vigente, quest o que foi posta ¨¤ an¨¢lise do Supremo Tribunal Federal por meio da ADPF 46-7, cujos contornos envolvem, dentre outros aspectos, o enquadramento do servi o postal como servi o p¨²blico, bem como o enquadramento constitucional das normas que atinem ¨¤ mat¨¦ria. THE ISSUE OF THE BRAZILLIAN POST SERVICE COMPANY¡äS MONOPOLY AND ADPF 46-7 ABSTRACT Among the forms of state intervention in the economic field stands out the intervention by absorption, which is the formation of monopolies involving certain activities of the Federal government. In this scenario, it is argued that the monopoly created under the auspices of the passed Constitution to the postal service and national air mail, played by the Brazilian post and Telegraph company called ¡°Correios¡±, had, in fact, approved by the prevailing constitutional law. That issue was put into the analysis of the Brazilian Supreme Court, through the judgment of ADPF 46-7, which contours involve, among other things, the framework of the postal service as a public service, as well as the constitutional framework of the rules that are related to the theme.
