%X Depuis 1930, la Belgique dispose de deux m¨¦canismes permettant soit l¡¯allongement de certaines peines, soit l¡¯ind¨¦termination de leur dur¨¦e. Il s¡¯agit, d¡¯une part, de l¡¯internement des d¨¦linquants anormaux et, d¡¯autre part, de la mise ¨¤ la disposition du gouvernement des r¨¦cidivistes et d¨¦linquants d¡¯habitude. En compl¨¦ment des autres pr¨¦sentations nationales du s¨¦minaire du GERN   Longues peines et peines ind¨¦finies. Punir la dangerosit¨¦  , l¡¯objet de cette contribution est double : pr¨¦senter le cadre normatif de ces m¨¦canismes en en soulignant les grands enjeux tels qu¡¯ils apparurent notamment dans les d¨¦bats entre juristes et m¨¦decins ; juger de l¡¯effectivit¨¦ de ces m¨¦canismes en examinant, tant que faire se peut, l¡¯usage qui en a ¨¦t¨¦ fait. Ever since 1930, two mechanisms have existed in Belgium which permit either the prolongation of certain kinds of punishment, or of imposing punishment without any date for its expiry. On the one hand these concern the confinement of mentally disordered offenders and, on the other hand, placing recidivists and habitual offenders under the control of the Executive (la mise ¨¤ la disposition du gouvernement). As a complement to the other national presentations to the GERN seminar   Long-term punishments and punishments of indeterminate length ¨C punishing dangerousness   the purpose of the present contribution is twofold: to set out the normative framework of these mechanisms, underlining what is seriously at stake, as has been shown in the debates between jurists and the medical profession; and to estimate the efficacy of these mechanisms by examining, so far as is possible, the use that has been made of them.
