%X 农村土地所有制改革是农村改革和发展的关键，在制度层面农村发展正受制于土地制度改革。对当前农村土地“三权分置”改革进行分析，认为集体所有制是特定历史时期的特有所有制形态，曾根据生产力发展状况进行调整，其中使用权的放权私有有效提高了生产效率。在当前，土地权属关系往往被严格限制在本村居民的政策底线约束下，土地集体所有制存在组织架构内部冲突、集体权利与成员权利冲突、承包权与经营权冲突等弊端，限制了土地资源配置效率，不利于农村发展。未来“三权分置”改革应在坚持集体所有制的大前提下，通过合理的制度设计，赋予农民充分的土地处分权，进一步完善农村土地的基本经营制度。<br>Rural land ownership reform is the key to rural reform and development. As for the system level, rural development is subject to the reform of the land system. This paper analyzes current reform of separating rural land ownership rights, contract rights, and management rights, and believes that the collective ownership is a unique ownership form in specific historical period, that can be adjusted to the development of productive forces, and the private property of the right to use can effectively improve efficiency of production. In the current policy line under the constraints of collective land ownership, the defects in collective ownership of internal conflict in the organizational structure, conflict between collective rights and members’ rights, and conflict between contracting rights and the management rights are limiting the efficiency of land resource allocation, and are not conducive to the interests of farmers and rural development. The reform of separating three rural and rights in the future should be carried out in the premise of insisting on the collective ownership, give farmers the full right to dispose of land through rational design of the system, in order to further improve the basic management system of rural land.
