%0 Journal Article %T The Problem of Whether the Betrayed Spouse May Claim Non pecuniary Damages from Third Person With Whom Her/His Spouse Has An Affair %J - %D 2018 %X In Turkish law having affair with a married person is not prohibited by any legal provision. It is controversial whether the betrayed spouse may claim non-pecuniary damages from the third person for pure adultery unless this person has violated her/his right of personality by another act. One of the conditions for the claim of compensation for the non-pecuniary damages based on tort liability is the violation of a personality right of the injured party by an act of the tortfeasor. Therefore the main point on the subject of the claim of non-pecuniary damages from the third person is whether the act of the third person violates any personality right of the betrayed spouse.
