%X “无讼”思想影响下的传统调解制度，作为中国传统法律文化思想的重要组成部分，是乡土社会礼治秩序下的特有产物，有其存在的社会根源、思想文化根源以及政治根源。对于传统中国而言，调解制度是适应社会需求和实现社会和谐的一种合理手段，具备一定的正当性和实践价值。在走向法治社会的今天，它在维系社会和谐稳定、构建多元化纠纷解决机制方面依然存在着一定的镜鉴作用。但“无讼”的理念和传统调解制度的存在也受到特定历史阶段和社会的限制，存在一定的局限性。随着社会多元化的发展，在推进社会治理现代化和新时代“枫桥经验”以及在尊重中国的法律文化传统和实际需求的基础上，传统调解制度进行现代转化是必然之势。通过重塑理念和价值取向，旨在达到道德教化和法律程序的有机平衡，让传统调解制度更多地关注人的尊严与权利。同时，从实践中反思现行制度的不足，提出完善人民调解制度和司法调解制度，构建新的基层治理模式助力“无讼”思想的进一步实现。<br />
As an important part of Chinese traditional legal culture, the traditional mediation system under the influence of the idea of “no litigation” is a unique product under the etiquette and rule order of rural society, and has its social, ideological and cultural roots as well as political roots. For traditional China, the mediation system is a reasonable means to meet the social needs and achieve social harmony, which has certain legitimacy and practical value. In today’s society of the rule of law, it still has a certain mirror role in maintaining social harmony and stability and building a diversified dispute resolution mechanism. However, the concept of “no litigation” and the existence of traditional mediation system are also restricted by specific historical stages and society, and there are certain limitations. With the development of social diversification, on the basis of promoting the modernization of social governance, “Fengqiao experience” in the new era, and respecting China’s legal culture tradition and actual needs, it is an inevitable trend for the traditional mediation system to be transformed into a modern one. By reshaping the concept and value orientation, it aims to achieve an organic balance between moral education and legal procedures, and make the traditional mediation system pay more attention to human dignity and rights. At the same time, reflecting on the shortcomings of the current system from practice, it is proposed to improve the people’s mediation system and judicial mediation system, and build a new grass-roots governance model to help further realize the idea of “no litigation”.
