Dilemmas and Countermeasures in Building a Digital Rule of Law Government %A 许莉莎 %J Open Journal of Legal Science %P 138-143 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/OJLS.2024.121021 %X 数字法治政府是数字政府法治化和法治政府数字化有机融合的时代产物,是面向数字社会的法治政府,是全面纳入法治轨道的数字政府建设探索。尽管当前我国在数字赋能和法治保障方面取得了一定的实践经验,但是仍然存在数字转型的目标异化、无法高效利用数据资源、数字技术和法治建设融合滞碍等困境。为了契合数字法治政府建设的内涵,从建设理念、数据利用、法治规范等方面解决上述问题具有现实必要性。树立以人民为中心的建设理念是数字政府建设朝着正确方向发展的必要保证。共享数据资源和保护数据安全是数字法治政府建设的内在要求。加强法治对数字行政的规范是推动数字技术效能最大化的根本要求,是实现数字技术和法治建设相融合的应有之义。
The digital government under the rule of law is the product of the era of organic integration of the rule of law and the digitization of the rule of law government, a government under the rule of law oriented to the digital society, and a digital government construction exploration that is fully integrated into the rule of law track. Although China has gained some practical experience in digital empowerment and legal protection, there are still dilemmas such as the alienation of the goal of digital transformation, the inability to efficiently use data resources, and the obstruction of the integration of digital technology and the construction of the rule of law. In order to fit the connotation of the construction of digital rule of law government, it is necessary to solve the above problems from the aspects of construction concept, data utilization and rule of law norms. Establishing the concept of people-centered construction is the necessary guarantee for the development of digital government construction in the right direction. Sharing data resources and protecting data security are the inherent requirements of the construction of digital rule of law government. Strengthening the rule of law to the standard of digital administration is the fundamental requirement to promote the maximum efficiency of digital technology, is to realize the integration of digital technology and rule of law construction. %K 行政法治,法治政府,数字政府
