Law Application of Foreign Intellectual Property Infringement in China %A 章慧蓉 %J Dispute Settlement %P 279-285 %@ 2379-3104 %D 2024 %I Hans Publishing %R 10.12677/DS.2024.101039 %X 在国际私法领域,被请求保护地法(lex loci protectionis)作为涉外知识产权侵权保护的准据法,已经得到了各国的普遍认可。我国在2011年颁布的《中华人民共和国涉外民事关系法律适用法》(以下简称《法律适用法》)的第50条规定了涉外知识产权侵权的法律适用规则并在涉外知识产权领域引入了被请求保护地法原则和意思自治原则,这是我国对涉外知识产权侵权保护的重大突破,也符合国际对涉外知识产权保护的趋势。当前涉外知识产权侵权案件与日剧增,在司法实践中我国法院对于涉外知识产权侵权纠纷的法律适用仍然存在着不少的问题。我国可以引入最密切联系原则、在实践中适用分割制、意思自治有限的扩张以完善涉外知识产权侵权的法律适用。
In the field of international private law, lex loci protectionis, as the applicable law for the protection of foreign intellectual property infringement, has been widely recognized by all countries. Article 50 of the “Law of the People’s Republic of China on the Application of Law on Foreign-Related Civil Relations” (hereinafter referred to as the “Law Application Law”) promulgated in 2011 stipulates the rules for the application of law on foreign-related intellectual property infringement and introduces the principles of the law of the place of Claimed protection and the principle of autonomy in the field of foreign-related intellectual property rights, which is a major breakthrough in the protection of foreign-related intellectual property infringement in China. It is also in line with the international trend of foreign-related intellectual property protection. At present, the foreign intellectual property infringement cases are increasing day by day. In judicial practice, there are still many problems in the application of law to foreign intellectual property infringement disputes in Chinese courts. In order to perfect the law application of foreign intellectual property infringement, China can introduce the principle of the closest connection, apply the division system in practice, and extend the limited autonomy of will. %K 涉外知识产权侵权,法律适用,被请求保护地,意思自治
