this paper aims to examine the nullity of procedures in the chilean civil procedure and determine the problems that exist in building a nullity legal system having as a base the main organizational structure of the procedural acts. it is proposed a new approach of the procedural nullity as a technique or instrument whose aim is to safeguard the legal system through the protection of the procedural guarantees of the litigants.
