Akty ultra vires w wietle odpowiedzialno ci organizacji mi dzynarodowych - wybrane zagadnienia

The analysis performed in this paper focuses on the issue of acts ultra vires of international organizations. Author examins the acts of authorities that exceed their rights (the ultra vires acts). For the prerequisites for illegality of an international organization's resolution should be indicated. It is significant that the authorities of international organizations should act within the scope of their competences. However, the organization is also responsible for actions and/or failures to act of their organs, even when they have exceeded their rights, or acted in contrast to the instructions given (the ultra vires acts). The international organization, as subject created by states on the power of international agreement, all its competences, including law-making competences, takes out from the contract of constitut on. However, the cases of undertaking this act in the situation of the lack of the competence are the causes of the unimportance of the institutional act of the international organization or with the crossing broadcast competence and in the case of the infringement of basic procedural requirements. Therefore, this paper is devoted to the most significant issues related to in.a. the premise of the responsibility of international organizations for ultra vires; acts examples of the crossing of the competence by international organizations; question of humanitarian intervention in the context of the responsibility of international organizations.
