Se propone una aproximación a la utilización del principio de proporcionalidad en el control de las leyes penales en la jurisprudencia del Tribunal Constitucional chileno y de la Corte Constitucional colombiana, para indagar en qué medida tal herramienta ha contribuido al propósito de elevar la racionalidad en el control de las decisiones político criminales del legislador. Con tal fin se examinan las diferencias que median entre los sistemas de justicia constitucional de Chile y Colombia para, sobre esta base, indagar si en qué medida y en qué ocasiones los tribunales constitucionales de ambos países han formulado las preguntas e incorporado las exigencias que reclama la aplicación de aquella herramienta argumentativa en el control constitucional de las leyes penales sustantivas. This work proposes to review the use of the principle of proportionality in the decisions of the Constitutional Courts of Chile and Colombia dealing with judicial review of criminal law. The purpose of the work is to investigate how such a tool has contributed to the function of increasing the rationality in the control of criminal political decisions of the legislative branch. To do so, the work first examines the differences between the constitutional justice systems. On this basis, it is ascertained whether, to what extent and on what occasions these constitutional courts have asked the questions and incorporated the demands that the proportionality principle as an argumentative tool in the judicial review of substantive criminal law requires.
