LAS PROFESIONES "ANáLOGAS" EN EL DELITO DE EJERCICIO ILEGAL DE LA MEDICINA DEL ARTíCULO 313 A) DEL CóDIGO PENAL CHILENO: PROPUESTA PARA SU DETERMINACIóN SIMILAR PROFESSIONS IN THE CRIME OF ILLEGAL EXERCISE OF THE MEDICAL ACTIVITY. ARTICLE 313 OF THE CHILEAN PENAL CODE: MOTION FOR ITS DETERMINATION

El artículo 313 a) del Código Penal sanciona el ejercicio ilegal de las profesiones médicas y contempla como tales a las descritas expresamente en el tipo y a todas aquellas que sean "análogas", en cuanto se vinculen con "la ciencia y arte de curar y precaver enfermedades del cuerpo humano". La precisión de este delito presenta varios problemas y uno de los más relevantes es justamente la extensión de este ejercicio ilegal en una época caracterizada por el aumento de la diversidad de las profesiones que concurren a la atención en salud. De allí que este estudio, a modo de limitar el alcance del tipo penal, se ocupe de construir ciertos criterios que sirvan de guía para determinar aquellas profesiones que sean "análogas" y por tanto susceptibles de ser ejercidas ilegalmente conforme al artículo 313 a). Article 313 a) of the penal code punishes the illegal practice of medical professions and as such provides expressly described in the type and all those that are "similar" as to engage with "the science and art of healing and guard against human diseases". The accuracy of this crime presents several problems and one of the most important is precisely the extent of this illegal practice in an era characterized by the increasing diversity of professions that are related to health care. Hence, this study, in a way to limit the criminal scope, it is about to build certain criteria to serve as a guide in determining those professions that are "similar" and therefore capable of being performed illegally under article 313 a).
