La "ratio iuris" del llamado "beneficium competentiae" en el ámbito dotal The "ratio iuris" of the so-called "beneficium competentiae" in the Dowry ScopeKeywords: Dote , Favor dotis , Actio rei uxoria , Beneficium competentiae , Maritus , Promissor dotis , Dowry , Favor dotis , Actio rei uxoria , Beneficium competentiae , Maritus , Promissor dotis Abstract: El estudio tiene la finalidad de evidenciar algunos aspectos de la praxis jurídica romana concerniente al llamado "beneficium competentiae" en el ámbito del derecho dotal; en particular, se expondrán las connotaciones del beneficio de la condena limitada al "id quod facere potest" en favor de los demandados por causa de la dote (dos): el maritus demandado con la actio rei uxoria para restituir las res dotalis después de la disolución del matrimonio; y aquellos sujetos (socer, mulier, extraneus) que habían prometido la dote y habían incumplido su promesa. De esta manera resalta la ratio iuris de la concesión del beneficio de la condena limitada según las épocas y los supuestos en que se basa. This study aims at bringing up some aspects of the Roman legal praxis regarding the so-called beneficium competentiae within the scope of the dowry law. Particularly, it presents the connotations of the benefit of the sentence limited to the id quod facere potest in favor of the (two) defendants in a dowry trial: the maritus claimed by means of the actio rei uxoria to reimburse the res dotalis after the dissolution of the marriage and those individuals (socer, mulier, extraneus) who promised a dowry and did not comply with their promise. Thus, the ratio iuris of granting the benefit of the limited sentence over time and the assumptions it is based on is highlighted.
