RECESS, RESCISSION AND INVALIDATION OF THE ADMINISTRATIVE DOCUMENTS

The recess of the administrativedocuments supposes the temporary, provisional cessationof the administrative documents and can be disposedwhen there is a doubt, an incertitude regarding thelawfulness and opportunity of an administrativedocument.The recess can be realized by the issuing organ,by the superior hierarchic body and not by the trialinstance.The rescission of the administrative documentsappoints the juridical operation through which the issuingbody disposes that the withdrawal of its own document tobe as result of the disposals of the superior hierarchicbody.In case that, principally, administrativedocuments are revocable, there are also exceptions fromthis rule, concerning individual administrative documents,the normative ones being always revocable.
