Stalking: una ricerca sull’”ammonimento del Questore” nella provincia di Bologna in riferimento alla Legge 38/2009 / Le stalking : analyse du rappel à la loi par le préfet de Police du département de Bologne (Loi n°38 du 2009) / Stalking: analysis of restraining order issued by the Chief of Police in the province of Bologna (law n° 38/2009)

The restraining order issued by the Chief of Police is a legal instrument that is used to protect the victim of stalking with the aim of dissuading the stalker from doing more persecutory acts. Neither executive decrees nor circulars are issued yet to define an equal national application procedure. For this reason, the author presents the procedure used by the Police headquarters of Bologna and the data concerning acts of stalking committed in Bologna and its province three years after the approval of the law n° 38/2009. La protection de la victime de harcèlement moral trouve dans le rappel à la loi de l’Autorité de Sécurité Publique un instrument juridique qui peut être utilisé afin de dissuader l’auteur de perpétrer d’autres actions criminelles. Compte tenu du de l’absence de décrets d’exécution et/ou de circulaires visant à une application uniforme de cet instrument au niveau national, nous présentons la procédure adoptée par le préfet de Police de Bologne, ainsi que les données relatives à ce phénomène concernent la ville et le département de Bologne, trois ans après la promulgation de la loi.
