Effectivenes of the fundamental social rights and the problem of the high cost of the health

This study aims to analyze the effectiveness of fundamental social rights, specifically the right to health, enshrined directly in the Federal Constitution, but which has serious problems of effectiveness, leaving thousands of people without their basic needs satisfied. This study seeks to analyze the behavior of the established public authorities responsible for implementing these rights, particularly those of public health policies. Conversely, the judicial authorities, when provoked, have been determining the performance of extremely expensive treatments with questionable results. Thus, there is a need to seek an alternative to this situation, which has on one hand the need for ensuring the fundamental right to health and, on the other, the absence of a fair, judicious and universal policy for its realization.
