Administrando soluciones posibles: medidas judiciales de protección de la ni ez

El objetivo de este artículo es indagar los modos a través de los cuales el ámbito judicial desarrolla diferentes intervenciones que teniendo como meta explícita la "protección" de ni os y ni as, se orientan también a administrar y normalizar sus familias. Para ello focalizamos nuestro análisis en expedientes judiciales relevados en un tribunal de menores y en un juzgado de familia, con el fin de describir las resoluciones y medidas dictadas, y de analizar la trama de relaciones y las interacciones producidas entre los agentes judiciales, administrativos y los familiares de los ni os, ya que a partir de ellas se configuran y postulan distintas soluciones posibles. Con este repertorio de soluciones, que serán ofrecidas o impuestas y que variarán a lo largo del proceso judicial, se busca componer un "orden familiar", ya sea preservando el vínculo de los ni os con su familia de origen o bien encaminándolos hacia la adopción. The objective of this article is to inquire about the ways through which the judiciary develops different interventions that, taking as explicit goal the "protection" of boys and girls, are also oriented at administering and normalizing their families. To such end, we focused our analysis on court records reviewed at a juvenile and family court, with the purpose of describing the resolutions and measures adopted, and of analyzing the scheme of relationships and interactions produced between the court clerks, administrative agents and the children's relatives, given that it is from them that we can configure and outline the different possible solutions. Collection of solutions that will be offered or imposed and that will vary throughout the judicial process, with which the formation of a "family order" is sought, either by preserving the relationship of the children with their family of origin or by orienting them towards adoption.
