O artigo tem como objetivo inicial fixara modelagem jurídica triangular típica dosdanos reflexos ou por ricochete, visando diminuira falta de clareza conceitual que o institutoapresenta. Em um segundo momento, o artigoanalisa os desenvolvimentos doutrinários e jurisprudenciaisrelacionados com a norma contidano artigo 948 do Código Civil, pois o seusuporte fático consubstancia o chamado “casoclássico”, por ser a única espécie de dano reflexofartamente desenvolvida no cenário nacional.Após estabelecer os parametros indenizatóriosrelacionados com o artigo 948 do Código Civil,o artigo busca novas hipóteses de danos reflexosindenizáveis, principalmente pela conex o comum dos conteúdos eficacionais típicos do princípioda fun o social do contrato, que flexibiliza oprincípio da relatividade dos efeitos contratuais.The article aims, initially, to set thetypical triangular legal modeling of the reflexdamage, aiming to reduce lack of conceptualclarity that the institute presents.
