A Dimens o Filosófica da Pós-Modernidade Jurídica: ponto de partida de uma reconstru o paradigmática

This article is in charge of one ofthe most important dimensions of the paradigmreconstruction of the Powder-modernity:the philosophical dimension. Leaving ofhighlighted points of the work of Nietzsche(the first powder-modern), and of the paradigmnotion as method, tries to really focusthe perspective of transmutation of the valuesin favor of a new conception; instead ofthe metaphysical truth the collective truth,that shows as built right. The focus presupposesother aspects of the proposal, as thetransformation corresponding of the politicianand juridical elements, those are objectof other texts of the author of this work.Institutions of inclusion are cogitated, thatseason direct and indirect democracy, so thatto each conflict one can obtain the best solutionfor the parts, the State and the Society.In that inclination, it is ended, the Powdermodernityis not an utopia, it is a method ofprojecting the transformations of a challengingreality, in that one should rescue the thirdelement: the commons. The rescue of thecommons will transform the paradigm mainof the Modernity.Este artigo ocupa-se de uma das dimens esmais importantes da reconstru o paradigmáticada Pós-Modernidade: a dimens o filosófica.Parte de pontos destacados da obra de Nietzsche,e adota a no o de paradigma como método, procurandoenfocar a perspectiva de transmuta odos valores em favor de uma nova concep o deverdade; contrapondo e justapondo à verdade metafísicaa verdade coletiva: a primeira centrada nasinstitui es políticas representativas e a segundamanifestando-se no campo da participa o.
