Os Juristas da Tradi o Ocidental: discursos e arquétipos fundamentais

: This article aims to analyze the historical constructions of discourses as well as the typical symbolism of the experts of the legal field during some specific periods of the Western tradition. From that perspective, under the “archetype” category, both the characteristics of such law experts and the production of their own rites and social roles are highlighted. This process of historical analysis emphasizes the peculiar symbolism resulting from the discourse of such social actors throughout pre-modern and modern historical formations. This work points to the fact that the perception of the historical articulation amid discourse, symbolism and power training is essential to evaluate the law area and its key players. Thus, critically evaluating contemporary law theories requires a minimal understanding of the complex social process in which jurists, in each historical moment, tend to assume certain symbolic representations so as to legitimate existing power structures.Resumo: O presente artigo analisa a constru o histórica dos discursos e a simbologia típica dos peritos do campo legal durante períodos específicos da tradi o ocidental. Nessa perspectiva, utilizando-se da categoria “arquétipo”, s o destacadas as características dos experts na lei e a produ o de seus ritos e papeis sociais próprios. Neste processo de análise histórica é evidenciada a simbologia peculiar decorrente da fala destes atores sociais ao longo de forma es históricas pré-modernas e modernas. O trabalho ressalta que a percep o da articula o histórica entre discurso, simbologia profissional e poder é fundamental para se avaliar o campo do direito e seus atores fundamentais. Dessa forma, para se avaliar criticamente as teorias jurídicas contemporaneas, é preciso que haja uma compreens o mínima desse complexo processo social em que os juristas, em cada momento histórico, tendem a assumir certas representa es simbólicas necessárias à legitima o de estruturas do poder vigente.
