This article aims to analyze the constitution of a subject of right capable of respect and esteem through the concept of capacity elaborated by Paul Ric ur. It intends to evaluate the capable, emancipated human being, the self that has an ethical and moral dimension and that is susceptible of ethical and juridical imputation, as it is explained in “Who is the Subject of Rights?” in The Just. There is an erratum for this article located here. Cet article se propose d’analyser la constitution d’un sujet de droit, entre respect et estime de soi, à travers l’analyse de la notion de capacité. Nous analyserons donc l’homme capable et émancipé, celui qui jaillit de la dimension morale – le sujet capable d’imputation éthico-juridique – au prisme du texte “Qui est le sujet de droit?” (Le Juste). Pretende-se analisar a constitui o de um sujeito do direito capaz de respeito e estima através do conceito de capacidade, elaborado por Paul Ric ur. Prop e-se avaliar o homem capaz, emancipado, que advém da dimens o moral, suscetível de imputa o ético-jurídica, conforme exposto no texto “Quem é o sujeito do direito?”, em O Justo 1.
