O presente artigo tem como objetivo analisar os aspectos jurídicos do panorama regulatório da produ o e comercializa o do biodiesel no Brasil, no contexto internacional de crescente demanda energética, onde os biocombustíveis surgem como uma alternativa renovável aos combustíveis fósseis. A metodologia empregada neste trabalho é de cunho qualitativo, com análise bibliográfica e documental da legisla o brasileira e internacional. A conclus o a que se chega é que os biocombustíveis apresentam grande potencial para se tornarem uma importante fonte sustentável de energia para o País, além da possibilidade de contribuírem para a melhoria do seu quadro social, através do desenvolvimento de programas de governo que contemplam a sua produ o pelos agricultores familiares. A contribui o deste trabalho decorre da constata o de que a Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP), órg o regulador das atividades relacionadas ao biodiesel no Brasil, tem seu foco nos aspectos econ micos como fundamento à sua atividade interventiva, especialmente na prote o ao consumidor. Excluída das atribui es da agência reguladora, a efetiva concretiza o da expressiva dimens o social ligada ao biodiesel, entretanto, carece de a es governamentais no sentido de implementar políticas de planejamento agrícola adequadas a cada regi o do país, conferindo suporte ao sistema cooperativo, bem como apoio técnico-financeiro ao agricultor familiar, a fim de elevá-lo a partícipe-chave neste contexto. This article aims to analyze the legal aspects of the regulatory overview of production and marketing of biodiesel in Brazil in the international context of increasing energy demand, where biofuels emerge as a renewable alternative to fossil fuels. The methodology used in this study is qualitative, with bibliographical and documentary analysis of Brazilian and international legislation. The conclusion reached is that biofuels have great potential to become an important source of energy for the country, in addition to the possibility that they could also help to improve the country's social levels through the development of government programs that address the production of these fuels by family farmers. The contribution of this work arises from the fact that the National Petroleum, Natural Gas and Biofuels Agency (Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP)), the regulatory agency that oversees biodiesel activities in Brazil, focuses on economic aspects as a basis for intervening, especially in consumer protection.
