Taqdiri Phenomenon In The Hanafi School With Respect To Kasani's Approach

The basic introduction of the taqdiri durum phenomenon was intended in this article. Theoretical research on the phenomenon was conducted by different schools with the exception of the Hanafi school. By investigating the definitions, explanations, and examples addressed in the previous research, the Hanafi approach on the phenomenon was intended to be identified. Throughout the paper, Bedai'u's sanai had an important impact on identifying the nature of taqdiri durum. The reason is because the phenomenon was used intensively and effectively in this book. Thus, Kasani's approach was at the center. In this context, the phenomenon can be described as the following using the term “taqdiri durum:” Resolving the uncertainities concerning the current issues related to the parties of a provision of shar’iyya, and treating a real situation that is the topic of a provision in a different way from its original use due to legitimate reasons
