An Analysis of the Insanity Value of ?er'u Men Kablena With Respect to Gazzali and the Early Period Hanafi Scholars

Abstract:

?er’u men kablana is defined as the religious laws announced through the prophets prior to Muhammad. ?slamic scholars have agreed that, the rules not stated in the Quran and Sunnah are not valid for the community of Muhammad. However, while these laws take place in Quran and Sunnah, these scholars are in conflict about whether they would be valid for us or not. In this context, the discussion mostly focuses on whether Muhammad followed these rules after his revelation. The views that have emerged after the evaluation of the issue can be divided into three: (i) When his prophecy was announced to him, Muhammad followed the rules of the previous religions. (ii) When his prophecy was announced to him, Muhammed dis not follow the rules of the previous religions. (iii) Rules of the previous religions are also binding for Muslims. Because these have become the Sharia of Muhammad (peace be upon him). Within the framework of these views, it appears to be a good choice to focus on Gazzali and his contemporary early period Hanafi Scholars in order to gain a better understanding of the topic. In this way, the views of scholars from Shafii and Haafi sects could be compared and the topic was addressed with respect to the hottest times of the discussion
