浅析我国商标使用情况说明制度的构建

Abstract:
2023年1月发布的《中华人民共和国商标法修订草案(征求意见稿)》第六十一条进一步强化了商标使用义务，要求商标权人自注册起每五年提交商标使用证据，并进行抽查。该制度脱胎于美国商标实践，美国在制度完善过程中业界的评价以及后续制度运行过程中出现的问题，均为我国构建商标使用情况说明制度提供了启发。我国在构建商标使用情况说明制度时，在形式上可以参考美国的有益实践，也需要在我国商标法框架内做好和现有制度的衔接工作。
Article 61 of the “Revised Draft of the Trademark Law of the People’s Republic of China (Draft for Comments)” issued in January 2023 further strengthens the obligation of use of trademarks, requiring trademark owners to submit evidence of use every five years from registration and conduct audit of such evidence. The system was born out of the trademark practice in the United States, whose improvement made and the problems found in the subsequent system operation provided inspiration for the construction of the trademark usage report system in China. We may refer to the practice of the United States and take its form when constructing the system of trademark usage report, but it is necessary to consider our existing system within the framework of trademark law.
