德国遗嘱执行制度研究
A Study of the German Probate System

遗嘱执行人制度在域外法中是一项十分系统的制度，但我国《民法典》尚无制度构建。虽然《民法典》中已经存在功能与之相似的遗产管理人制度。但需完善制度，完善在司法实践中的理论适用。本文系统地讲述德国遗嘱执行制度，从遗嘱执行指示概念起，介绍遗嘱执行类型、遗嘱执行人的选任及证明、遗嘱执行人的权利与义务。通过对于德国遗嘱执行人制度的系统梳理，期冀通过借鉴先进典型以打通遗嘱继承执行内部法理，进而为我国未来的继承领域法律规范完善贡献力量。
The executor system is a very systematic system in extraterritorial law, but there is no system built into our “Civil Code” yet. Although a system of administrators of estates with similar functions already exists in the “Civil Code”. But need to improve the system, improve the theoretical application in judicial practice. This article systematically describes the German probate system, starting with the concept of probate instructions and describing the types of probate, the selection and proving of the executor, and the rights and obligations of the executor. Through the systematic combing of the German executor system, it is hoped that through the reference to the advanced models in order to pass the internal jurisprudence of the execution of will inheritance, and then contribute to the improvement of the legal norms in the field of inheritance in China in the future.
