互联网背景下金融消费者隐私权保护路径探究

随着网络经济的发展，包括个人信息在内的金融隐私已成为一种重要的资源与财富。互联网金融借助网络技术的低成本、高效率、大覆盖等优点，推动了整个金融市场朝着电子化、无纸化和虚拟化方向发展。但是，它在给大多数金融消费者带来极大方便的同时，也带来了隐私侵犯的风险。本文立足于对金融消费者隐私的定义与实践需求，对其存在的不足进行梳理与剖析，并在比较法视角下从构建符合我国国情的金融隐私权保护机制、规范相关监督管理机制、提高金融消费者风险意识三个维度完善我国金融消费者隐私权保护路径选择。
With the development of the Internet economy, financial privacy, including personal information, has become an important resource and asset. With the advantages of low cost, high efficiency and large coverage of network technology, Internet finance has promoted the development of the entire financial market in the direction of electronic, paperless and virtualization. However, while it brings great convenience to most financial consumers, it also brings the risk of privacy invasion. This paper is based on the definition of financial consumer privacy and practice needs, combing and analyzing its deficiencies, and in the comparative law perspective from the construction of financial privacy protection mechanism in line with China’s national conditions, standardize the relevant supervision mechanism, and improve the risk awareness of financial consumers to improve the protection of financial consumers in China’s financial privacy protection path choice in three dimensions.
