近年来，航空货运代理的职能随着物流业的快速发展发生了很大转变，货运代理人已经突破了传统的定义，开始以多种身份参与航空运输活动。有时是当事人代理人，有时是运输合同当事人，在业务顺利开展的情况下其法律地位并不存在争议，而一旦出现不确定因素或突发情况，则会大幅增加相关交易主体的经营风险，实践中已经发生多起货运代理的纠纷。因此本文针对航空货运代理企业的法律的制度不完善导致货运代理企业法律地位模糊，责任承担界限不明的问题，运用实证研究分析的研究方法，剖析航空货运代理企业的法律地位、适用规则，并对目前存在的问题提出了相应的完善建议。
