老龄化背景下养老机构的法律风险及其应对路径
Legal Risks of Elderly Care Institutions and Their Countermeasures in the Context of Aging

在老龄化社会背景下，养老机构作为我国养老服务体系的重要支撑点，在养老市场积极活跃的同时，也隐含着一定的法律风险。本文对904个裁判案例进行实证分析，归纳得出养老机构服务领域的法律风险主要包括养老机构基础设施不完善、养老服务协议约定混乱以及法院对于养老机构过错认定标准不统一等引起的权责纠纷。推动养老机构合法合规运营、化解养老服务供求双方权责纠纷，应从提升监管力度、引入责任保险制度、统一过错认定标准等角度入手，通过持续的努力和改革，在保障老年人权益的同时，实现养老机构的可持续发展。
In the context of aging society, elderly care institutions, as an important support point of China’s elderly care service system, are actively active in the elderly care market at the same time, but also imply certain legal risks. This paper analyzes 904 adjudication cases empirically, and concludes that the legal risks in the field of elderly care institutions’ services mainly include disputes over rights and responsibilities caused by imperfect infrastructure of elderly care institutions, confusing agreements on elderly care services, and inconsistent standards of the court’s determination of the faults of elderly care institutions. In order to promote the legal and compliant operation of elderly care institutions and resolve the disputes between the supply and demand of elderly care services, it is necessary to improve the supervision, introduce the liability insurance system, standardize the fault determination standard, etc., so as to realize the sustainable development of elderly care institutions while protecting the rights and interests of the elderly through continuous efforts and reforms.
