Los contratos temporales y a tiempo parcial como formas de trabajo atípicas: Especial referencia a su régimen de seguridad social

Abstract:

up to the beginning of the 1980s, the spanish labor market was characterized by rigid labor relations as well as high strike rates, concentrated particularly in women and youth, that did not permit facing changes in the entrepreneurial market. from 1984 on, a flexibilizing tendency began with the adoption of a legal package that supposed, among other advantages, the implantation of measures to facilitate entering and leaving a job, stimulate the incorporation of youth, women and those who had been out of work for a long time into the labor market, the liberalization of temporary work contracts through the rupture of the causal connection, and the implantation of three types of atypical contracts: the temporary contract to foment employment, the training contract and the contract for practices. nevertheless, the search for industrial flexibility brought the labor market to a precarious situation; furthermore, excessive recurrence to temporary contracting removes the incentive for entrepreneurial investment in training workers, possibly risking a lack of motivation, stagnation or worsening in entrepreneurial productivity and competitiveness. conclusions were that of all the forms of atypical work, those that are recurred to most and that include a greater percentage of workers are: temporary contracts and part-time contracts. the latter is what most social security specialists review, fundamentally in terms of valuation, unemployment protection and retirement. likewise, even though at first sight it seems that temporary and part-time contracting only bring advantages for entrepreneurial activity, this is not completely true; these forms of contracting make it possible for persons to enter the labor market who, because they have another type of priorities, such as attention to family life or education, previously would have had to abandon work or incorporate themselves into the labor market later.
