Tipos penales relacionados con el Derecho del Trabajo y la Seguridad Social: Breve análisis comparativo entre la Legislación Venezolana y Espa？ola

the objective of this documentary-type study is to examine some of the penal types found in the venezuelan legal code related to labor law and social security, in terms of the active subject, the passive subject, legally protected right and the elements surrounding each one. to pursue this objective, penal types in venezuelan legislation were examined comparatively with some penal types established in the spanish penal code. likewise, venezuelan and spanish doctrines regarding the theme were analyzed, concluding that penal types related to labor law and social security in venezuela are not limited only to those indicated in the organic law of prevention, conditions and work environment, and even when the national legislator has intended to decrease the number of work accidents and occupational illnesses by creating new penal types or making the sanctions for those that exist more severe, such mechanisms have not produced the desired effect.
