in this article the development of human rights of indigenous peoples in latin america is analyzed, in parallel, the author makes a critical and scholar exposition on the criteria that the inter-american court of human rights has adopted in defense of the indigenous communities territories. also, the author gives us an introduction about the theory regarding the collective property over the territory of indigenous peoples and the different ways they should benefit from it.
