Incidencia de la aplicación de la Ley orgánica de procesos electorales en los resultados de las elecciones de diputados en septiembre de 2010

the constitution of 1999 embodies principles related to suffrage and those of proportional representation for the elections in our country, without indicating which is the proportion among them. the organic law of electoral processes respects the mixed system but gives personalization a higher value over proportional representation. this article is intended to demonstrate that the intention of the constituent member was that both systems could be applied in equal terms. it is also intended to demonstrate that the law created, as a distortion, a change of parity, which had evident impacts in the electoral results. moreover, the faculty to redistribute the electoral circuits according to its judgement, that was given to the national electoral council, is also reflected in the electoral results.
