清代保甲法律制度之探析
An Analysis of the Legal System of Baojia in the Qing Dynasty

清代保甲法律制度是以保甲为基本组织形式，以维护地方秩序稳定为主要职能，以保甲法令为中心，用以巩固清王朝中央政权的一系列规章制度，属于清朝行政法律系统的重要组成部分。本文以清朝时期的档案资料为依托，梳理了保甲法律制度的变迁过程，探寻了保甲法律制度的法律渊源，总结了保甲法律制度的主要内容，评析了该法律制度对清朝社会所产生的积极与消极影响。
The legal system of Baojia in the Qing Dynasty was an important part of the administrative and legal system of the Qing Dynasty, with Baojia as the basic organizational form, the maintenance of local order and stability as the main function, and the Baojia decree as the center. Based on the archival materials of the Qing Dynasty, this paper sorts out the process of establishing the legal system of Baojia, explores the legal sources of the legal system of Baojia, summarizes the main contents of the legal system of Baojia, and analyzes the shortcomings of the legal system in its operation and its positive impact on the maintenance of social order in the Qing Dynasty.
