this paper constitute a reflexive essay about one of the fundamental issues that comparative constitutional law and international law of human rights, present in emergency statesfor 21st century: the role of judicial warrants as a way to effectively protect fundamental rights. with an integrational and constitutional (dynamical and developer) points of view we explain the concepts ut supra mentioned. we focus the normative dimension in comparative constitutional law, interamerican human rights system, andmercosur's law. finally, we present some reflection and analysis, re-reading the judicial effective protection of human rights for it strengthening, in exceptional moment.
